Spain’s Immigration Law 2025: Key Changes and Data Comparison

Spain is introducing major immigration reforms in May 2025. These reforms will make it easier for foreign residents to obtain and renew permits, work legally, and reunite with family members. 

The changes will provide greater stability and flexibility for those looking to build their lives in Spain. 

Below, we break down the most important updates and what they mean for you.

The reduction of the required residency period for social integration (arraigo social) from three years to two years is undoubtedly one of the most impactful changes. 

This means that foreigners who have been living in Spain irregularly can apply for regularization sooner, provided they meet the necessary criteria, such as proof of social integration and employment.

The so-called "second chance" arraigo now allows individuals who previously held a residence permit (but did not renew it) to regain legal status after just two years of residence, instead of three. 

This change is a clear benefit for those who faced bureaucratic or employment difficulties that led to permit expiration.

"Irregularidad sobrevenida" refers to situations where a foreign resident loses legal status after previously holding a valid residence permit. 

The new regulations will streamline the process of regaining residency for those who have become undocumented due to permit expiration or legal lapses.

The new system will make life easier for anyone wanting to build a life in Spain by removing the need for annual paperwork. 

The initial residence authorisation will now last one year, with subsequent renewals granted for four years instead of shorter periods. This provides greater security and reduces the bureaucratic burden on residents.

The old system, where residence permits were valid from the date of application, was inefficient and caused delays. 

The new law guarantees residency takes effect immediately from the moment it is granted, ensuring a smoother transition for applicants.

The "job-seeking visa" is now valid for one year instead of just three months, making it a major improvement for those seeking employment in Spain. 

This gives applicants more time to find work in designated sectors and locations.

Previous rules clearly stated that certain residence permits only allowed either employment or self-employment (autónomo), but not both. 

The 2025 reforms removed this restriction, allowing residents to work both as employees and freelancers from the start.

The new regulations bring two major changes to family reunification:

• There is no longer an age limit for parents of Spanish nationals (previously set at 65+). This means that ascendants of Spanish citizens can now apply for residency regardless of age.

• Children's age for reunification has been extended to 26 years (previously 21), allowing young adults greater flexibility to live with their families in Spain.

Students in Spain will now receive study permits that match the duration of their program. This eliminates unnecessary renewals and paperwork. 

However, it is important to note that language students and language assistants (Auxiliares de Conversación) will not be eligible for automatic work permits after completing their studies.
